Bill H.3536, S.56 in South Carolina: Workman's Comp Completely Paid by Company Mandating a Vaccine
A company should be responsible if it mandates an employee to take any vaccination.
The following bill is in the Judiciary committee of the House. There is also a Senate version.
TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY ADDING SECTION 42-9-50 SO AS TO PROVIDE THAT ADVERSE HEALTH CONDITIONS OR DEATH CAUSED BY AN EMPLOYER-MANDATED COVID-19 VACCINE ARE COMPENSABLE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 9, Title 42 of the S.C. Code is amended by adding:
Section 42-9-50. All adverse health conditions or death arising as a result of receiving a COVID-19 vaccination mandated by an employer or the local, state, or federal government are compensable pursuant to this chapter.
This requires workman’s compensation as if the employee was injured on the job. I don’t know is the phrasing is good enough to force the employee to pay all the workman’s comp without the state’s contribution. That is the way it should be.
I’m also concerned about limiting this bill to Covid-19. I would remove Covid-19 completely from the bill, requiring the company to be responsible for all workman’s comp for any vaccine mandate.
This is actually bad as workers comp limits employer liability. Whoever forced the jab should face full liability
